Consulted with Mr. Kelly when our daughter went to jail for a probation violation. Mr. Kelly was very professional with his advice, explained things very clearly, agreed to help her, and was very honest in adding we might not need his services if the Probation Officer offered her a deal without the n...eed for a hearing. She did plea guilty and it was settled without a hearing. At the same time,we also asked Mr. Kelly to represent our daughter on harassment charges in a different county, it could have been difficult for her, since she is on probation in that county. Mr. Kelly notified the court that he would be representing her in a plea of not guilty. We received a notice of withdrawal of charges in that case. Both cases had a good outcome for our daughter. We cannot thank Mr. Kelly enough for the peace of mind he gave my husband and I, along with our daughter. We were not charged for his time, and we will not forget his understanding. We called Mr. Kelly since represented our daughter in 2013, resulting in most of the charges being dropped, and another serious charge being reduced all the was down. I hired Evan Kelly to protect me from charges in the late fall of 2016. He promised me that he would be successful and that he would be able to have the incriminating charges dropped. He was not successful. I asked him if he would petition the court to have the dropped charges removed from my file an...d he said yes. He did not File the Petition. In August 2017 I approached Mr. Kelly with a plan to expunge all charges; he agreed to pursue with the District Attorney. All fines, restitution, Community Service, Drug Test, and responsiveness to the Probation Department was complete. He told me to get the concurrence of the Probation Department that they would not stand in the way of discussions with the District Attorney's office and to pay all fines. This was done. Mr . Kelly was provided a receipt from the Cashier's office. He never had the discussions . In addition, he denied me due process by not pursuing relief under the ARD Law for first time offenders. Although the law was targeted to DUI first time offenders , other cases had been successfully brought. I would not recommend his services to anyone; he told me he was unlike the other attorneys; he would do what he said, he would not overcharge me and he could be trusted. In the fall of 2018, I placed at least 10 phone calls and 5 emails to his office to discuss matters with him. He did not have time. I think he did not want to face up to his subpar performance. Because of his attitude, I had to hire another lawyer at a total cost of $1,100 including Court Fees to process expungement of dropped charges. And it was today that I learned from my attorney that Mr Kelly did not petition my case as an ARD matter. There is no record resident in the Chester County Courthouse.
