Description: Ms. Shah, a native of Pakistan, petitioned for review of decision of Board of Immigration Appeals (BIA) denying her asylum claim. The Third Circuit found that the Immigration Judge's (IJ) conclusions that her father was not dead, and that she thus was not credible, were not supported by substantial evidence. The Court harshly criticized the Immigration Judge for ignoring evidence in the record that demonstrated her father had indeed been murdered, including newspaper articles with photos, a death certificate, and proof that death benefits had been paid to the family.
