    Stewart’s Answer

Generally, the two year limitations period will bar all negligence claims. The township, as a political subdivision, might pose further problems from an insurance recovery standpoint. There are sometimes exceptions. Meet with an attorney, he or she might be able to identify a way around this problem.

  • How do I go about a lawsuit?

I have worked for the City of Erie from 1999-2013 my wages were $7.00-$7.50 an hour and I work 40 hours a week. I have watched many workers hired over me and they were not with the company long, many co-workers have used racial jokes and slur I ha...

    Stewart’s Answer

If it's a discrimination claim you seek, you need to file an administrative claim with 180/300 days of the incident. If you haven't worked for the city in 3 years, and you did not file with the eeoc or phrc, then your discrimination claim might be time barred

  • I'm meeting my public defender the day of the preliminary hearing, how would they know what's going on?

I was told I will be meeting my pd the day of my preliminary hearing, that doesn't make any sense why is it being done that way. They wont be able to really help me

    Stewart’s Answer

Unfortunately that is the main criticism I hear about the public defenders office. You have the option of retaining private counsel, many offer affordable rates and payment plans. Generally, a preliminary hearing doesn't involve the defendant putting on evidence (although you have that right)? Instead, it is a chance to explore the sufficiency of the evidence that the Commonwealth has against you.

  • What do I do about a law suit from a car accident in 2014?

I was in an accident in 2014. I stuck a pedestrian while making a left turn. No ticket was issued. I have a copy of the police report. According to my car insurance company the claim is still open.

    Stewart’s Answer

Unless the pedestrian was a minor, there is generally a two year window that the claim will remain open to see if s suit is filed. If you are sued, immediately inform your carrier from 2014 and they will hire you a lawyer

  • What to do if at-fault driver's insurance company cannot contact him?

    Stewart’s Answer

If the at fault carrier has independently concluded that their driver is at fault, they have a duty to pay the liability property damage limits which would include your deductible. They can only disclaim coverage for non cooperation in relation to the other drivers damages. Of course, it is risky to try to settle the claim with the other carrier especially if you had other injuries or damages that weren't covered ask your carrier if they intend to subrogate, if so, then they might be able to recover your deductible in intercompany arbitration

    Stewart’s Answer

Without commenting on whether the appeal from a motion itself is proper, one option might be to take an assignment from the present executor. You might also encounter issues with standing (ie the right to bring a claim yourself). This would depend in the interest you are asserting and whether you personally are a proper party. Otherwise, try a mandamus petition asking the superior court to allow you to open the trial court proceedings to amend the caption. It would help of the other side has no objections. Without knowing more about the nature of the case and grounds for appeal, it is generally difficult to provide advice
