I had my first DUI 18 years ago and went thru the ARD Program. I have 2 hearings, 1in Oct. And 1 in Nov. For the DUI charge I received this Aug. Do I need a lawyer?
You should absolutely have an attorney for a second offense DUI. As attorney Barber stated you should at least consult with an attorney so you can go over all your options including any possible defenses.See question
My Cousin got a DUI in June of 2015, and was placed in an ARD program in January. She hasn't made any monthly payments in 5 months. What is supposed to happen to her?
I would make sure that your cousin speaks to an attorney ASAP. If someone is placed into ARD and doesn't pay their fines and costs they can be removed from the program and then will have to take the case to trial or enter a guilty plea.See question
I wanted to get this all over with as soon as possible so I foolishly asked for weekend jail in 2 weeks and I've smoked recently.
First of all you want to be careful about what you write on sites like these because you never know who is reading. Secondly you should always make sure that you are alcohol and drug free when going to a prison to serve anytime because they can test you. I would talk to your attorney that you used in this case or talk with another attorney as soon as possible.See question

First you should definitely talk with a DUI attorney in this county. You are looking at a 1 month suspension if your accepted into the ARD program. Unfortunately, Pennsylvania will not give out an occupational limited license for ARD. Your attorney may be able to see about going into ARD at the lowest tier which would not trigger a suspension. In addition, a qualified DUI attorney should go over any possible defenses you may have with your case. Most attorneys will give you a free consultation including myself.
Good Luck.See question
I got a dui in February in PA. My court docket says dui 1st offense highest tier. It is my third dui within the last 10 years. Can the prior dui's be held against me?
Absolutely. Although your paperwork states this is your first offense, when the paperwork makes it up to the County they will be able to see any priors and amend accordingly. You are facing a potential year in prison depending on your blood alcohol level. You should contact a qualified DUI attorney immediately so you can go over any possible defenses as well as any other options that you may have. Most attorneys including myself will offer you a free consultation.

I was pulled for suspicion of DUI after running my plate and it came back my license was under suspension.
First thing you should do is hire an attorney that handles DUI cases in this County. The facts as you describe would make it a 2nd offense DUI since the look back period in PA is 10 years. This does not automatically mean that the prosecutor will ask for the manditory minimum. You will want to sit down with an attorney and go over all possible defenses and options that you have. I wish you good luck.See question

First thing you will want to do is hire a qualified DUI attorney. In your situation there is a mandatory minimum sentences that must be imposed by the judge of 30 days. However an attorney will be able to talk with you about other potential sentencing alternatives including house arrest. Again you should talk to a DUI attorney immediately. Most attorneys on this site including myself offer a free consultation. Thanks for the question and Good Luck.See question
