Attorney Shearer was recommended to me to handle an estate for which I was the executor. What should have been a fairly uncomplicated process, turned into a nightmare. She was so inept, that I had to hire a different attorney to pressure her into doing her job, and to protect myself. 7 months later, finally, the proper paperwork was submitted and the Judge accepted my resignation. Atty. Shearer requested to be the replacement executor, but the Judge decided to reassigned the estate to a DIFFERENT attorney! (It's been 9 months and still, the estate has not been settled!)
I thought I had renounced my executorship in March. As far as I knew, I was not the executor and she was my replacement. I had no reason to question this belief especially since she was making decisions and taking actions as the executor for the estate. In March, she had her notary public stamp my letter of renouncement and told me she would file it with the court. She thought it would take up to ten days for a court response. What she was either ignorant of, or didn't acknowledge to me, was that the way in which I resigned/renounced, was different from the accepted method required by the court. It took her 4 months to (re)file the proper papers with the correct information! It was rejected one time because there were too many errors!
Att. Gail Shearer rarely returned phone calls. In order to communicate with her, I had to resort to texting and then email. I saved my correspondences. I often asked if I was still listed as executor but she delayed and delayed answering that question. Finally, I resorted to calling Orphans Court myself.
She interfered to the point where I've been threatened twice with lawsuits. Once, by an Attorney who bought items from the estate and again, by the funeral director. In the first case, while knowing the check was cashed, she ordered that no one could allow the items bought and paid for, to leave the house. Months later, my new attorney got her to agree to refund a portion of his payment. In the second case, she didn't communicate with the funeral director to explain the complications with the estate. He thought no one intended on paying the bill. My brother ended up giving him a partial payment.
Attorney Shearer uses delay tactics and untruths. She told my new attorney that one reason for the delay in filing papers was because I hadn't yet signed a document. What Atty. Shearer didn't know was that my new attorney had a copy of the paper, which of course, held my signature. She told me that other people were lying to me but the only person who lied to me, repeatedly, was her.
These last 9 months have been beyond stressful. I hope to never have dealings with her in the future. If you are considering hiring her, it might help to ask other local attorneys about her reputation in the law field. Although lawyers don't like to talk poorly about colleagues, two shared their opinions with me. I wish I had followed my own advice before I met Attorney Shearer.
