Your attorney should be able to file a motion to have the judge order the prison to dispense your proper medications. Your attorney will have to contact your doctors first in order to prepare it.

  • My daughter father left her when she was a baby never been in her life and now filed for custody after 6 years is it possible

he would have a chance for custody

    Marakay’s Answer

Since you have only been in Florida for 3 months this is still a New York case. You should be able to find a qualified attorney to ask in Florida by searching right here on Avvo. If you check their profiles, they will indicate if they do family law and if they also handle New York law.

Adult adoptions are perfectly legal. However, there would need to be a hearing on this. Adoption law is not something you should attempt to guess at -- do use an attorney.

  • My daughter father left her when she was a baby never been in her life and now filed for custody after 6 years is it possible

he would have a chance for custody

    Marakay’s Answer

Yes. Unless a biological parent's rights have been terminated by a court, they are still a legal parent who can file for custodial rights. The fact that they can file, however, doesn't mean that they will win. A parent who has never been involved in a child's life when they could have been had they chosen to do so is a parent not likely to win custody. However, that parent may still be entitled to visitation that may increase over time.

  • Same-sex adultery grounds for divorce?

I am trying to file for divorce for same sex adultery in MD. Does anyone know of case law that was denied due to this. I know the Annotated code states intercourse, but was wondering if there was a case law explaining this better. thanks!

    Marakay’s Answer

At the present time, most courts consider cheating to be cheating regardless of the gender of your spouse's partner. As long as sexual activity took place, it's considered to be adultery.

  • I have a summons/Ticket waiting for trial Virginia code 18.2-160.1 & traveling to Canada prior to said trial. Is this a problem?

Will I encounter trouble entering Canada? Any precautions I should take?

    Marakay’s Answer

No, this will not prevent entry into Canada. You have not been convicted of this, so it is not on a criminal record of any sort, and even merely having a criminal record will not automatically keep you from being allowed to enter Canada. Further, you will not be examined within an inch of your life at the Canadian border; crossing international lines at the Canadian border is a relatively informal affair (usually done at a drive-up checkpoint if you are going by car, where you present ID). Sometimes it's trickier to re-enter the US, as you'll be asked about purchases and the like.

Just be sure to come home in time for your hearing. And enjoy your trip.

  • PLEASE HONEST ANSWERS ONLY!!

Should I hire an attorney right away or wait till the arraingment to hire a lawyer? In other words would it make a difference if I do it now or after arraingment???

    Marakay’s Answer

Hire an attorney now. While I agree with the first contributor I would also add that the sooner you have counsel, the sooner you will understand the case much better. The earlier you fully understand the charges and any possible outcomes, the earlier you can make educated decisions about the best way to handle your case. Even if charges are not likely to be dropped, you may be eligible for alternative sentencing, reduced charges, or diversionary programs that you may not know about without counsel, some of which may require that you are aware of them at or near the time of arraignment.

  • I was ticketed for driveing on suspention in walmart parking lot this is private property i was told by my maniger that they cou

the lights didnt come on in till i was geting out of my vehicale

    Marakay’s Answer

Surprisingly, although a store parking lot is in theory private property, the police do have a right to enforce traffic laws there. It's not the same as operating farm equipment or farm vehicles on your own property (in many states even minors can operate farm vehicles without licenses on family property). If you have an accident in a parking lot, the police can issue a citation for that. They can, and do, also enforce driving laws. Although the property is privately owned, it is an area where many people do congregate in a public fashion and where police will enforce traffic and safety laws. Besides, if you're on their lot operating a vehicle while on a suspended license, you'll have to explain how you got the vehicle there.

  • Howw can my wife be served divorce papers if she lives in Colombia

My wife and i married in Ny she now lives in colombia and lives with another manu whith whom she has a new babie. I want to divorce her but what are the lwas for her to be served? Regardless wheather she signs or not.

    Marakay’s Answer

As you know what she's doing, I gather you may also have an address for her. You can do international registered mail, which would return a card to you that would tell you that she received it, and this is effective for service in most states. Alternatively if you wish to spend the money, she can be served in person by someone in Colombia. If you use a lawyer for your divorce, the lawyer will find the person to do this and arrange for service of the papers. The service in Colombia must meet the provisions of your state's rules of court.

    Marakay’s Answer

You do need to have a lawyer review your letter and any other paperwork you have in order to determine just what sort of court date you have.

I do not know if Washington has a three strikes rule, but you would do well to try to avoid having any more charges against you. It is worth losing supposed friends to keep yourself out of serious trouble. Supposed friendships are not worth the possibility of serious fines or jail time, and people who ask you to commit crimes are not your friends.
