Description: Plaintiff was a 24 year old accountant. He was hospitalized with a brain mass. His surgery was scheduled for next morning when he developed a fixed and dilated pupil. The nurse failed to tell the neurosurgeon about this serious change in his condition. Because the neurosurgeon was not told of this serious change in the patient's condition his brain herniated and he died a few days later. Had the neurosurgeon been told surgery could have been done and the patient would have lived and gone back to work as an accountant. The jury found against the hospital and awarded $2,500,000 in damages.
