    The District Judge's office may have your case may be listed as "Inactive". As Attorney Myshin has already suggested, it will most likely be worth your while to speak with an experienced Criminal Defense Attorney within that county.

    If you were represented by an attorney at your Preliminary Hearing you should direct this question to your attorney for an answer specific to your case. Generally speaking, in some cases a complete and full Drug & Alcohol Assessment is required depending on the BAC. This is in addition to the mandatory CRN eval. & is usually conducted before the A.R.D. Hearing would take place (ARD Hearing or when you are formally admitted into the program). Generally, it's always best to err on the side of caution and prepare to undergo a drug test. Any additional details should be discussed with your attorney, especially if results of that test would or could cause problems.

    Good Morning, I'm assuming you took the ARD program for your first time DUI?

    Although every county in Pennsylvania may be a little bit different when it comes to the procedure for filing/requesting a Petition for early termination of ARD probation, as long as you've served some of your permission to have all of your requirements completed in proof of everything I'm sure it's possible to at least request it or file a petition. some counties require you to serve at least half of your probation period / or 6 months before considering granting your request. Speak to your probation officer and/or contact an attorney with in the county that the offense occurred to find out the details.

    Under what circumstances would a lawyer ever tell the client to admit guilt and cooperate with the government? I know a sentence is up to the judge. How can someone trust the government will make a good recommendation for cooperation?

    To answer this question, numerous factors would need considered...the facts of the case, & allegations against the person., existing evidence , witnesses, prior record score, and what is being offered in exchange for cooperation. An attorney can make recommendations to his or her client but ultimately it's the client who decides which route is best for them. If you're in a situation like what you described, you can always choose to interview multiple attorneys to find the right one for you.

    It is difficult to answer your question completely based on the information you have provided. There may be certain defenses in your case that an experienced Attorney would be able to identify but more information would be needed. You may want to schedule a consultation with a local Attorney and have them review your case. After they have discussed the case with you and reviewed your Criminal Complaint along with the Affidavit of Probable Cause, they should be able to tell you what possible defenses there are in your case.

    Contact a local Attorney immediately, especially since court is tomorrow! It sounds like you are ready to fight for what you feel is right, so it's time to get an Attorney! It's sometimes confusing when you have so much going on and are asked to sign documents. Many people in this situation do not realize how signing a single document can cause so many problems for them in the future. Having an Attorney who is experienced in this area and will fight for your rights, will benefit you tremendously here.

    You should consult with a local Attorney before doing anything! Once you start to give statements and answer questions, the information you provide can not be taken back! Even though it may not seem like you have anything to worry about by meeting with the police, protect yourself against self-incrimination and at least speak to an Attorney before you make your final decision on how to proceed!
