  • Can a person be arrested for trespassing when one person of the residence doesn't want him there but another does?

    My boyfriend drops me.off every now and then and my dad is threatening to call the police on him and have him arrested for trespassing. Does he have the legal right to do so if I live there too and he doesn't even leave the car?

    Technically, as the owner of the property he can. If you are under 18 he can. If you are over 18 it becomes slightly more complicated. On the other hand you live in a fairly rural area and if you want to avoid having your B/f arrested, and you are of age, move out or get a written agreement that your dad will stop harassing your guests ir invitees as long as they are comporting with the law

    Take your tape to Police but were I you, i'd go with a lawyer. In fact the lawyer may have ideas that can result in a faster stronger punishment

    They ought to. She was very stupid to do this. This is more than just a petty larceny, it is bank fraud and potentially more. These could easily be a Federal case. Your friend ought to consult counsel, COMPETENT Counsel, right away. Anybody saying to lie low and hope it passes isn't competent.

    You would be well served to speak to an Entertainment attorney in NYC. This isn't so much a security case as it is a contract action. There are a number of options you may have here but I would be remiss to review them all without knowing more facts. Get to a lawyer pronto. Your SOL Time is ticking away

    Techincally you could face u to a year in jail. That is not likely however, assuming no violence and low record. You do not state whether you were living there or not but if you were the police should not have arrested you without the eviction taking place. You need a criminal defense lawyer not a civil rights lawyer.

    Depending on where and when, it could be both civil and criminal
    1. Did you consent to the filming
    2. Where and when did the filming take place (if it was in a public place or a place even within a home were a reasonable person would not have an expectation of privacy then its a strictly civil matter If it was filmed and or circulated before the start date of Caroline's law it is also civil.

    Once you have had the criminal charges dismissed yes you can sue. You should send in a notice of claim. Sounds like you need a criminal defense/ Civil Rights lawyer. I know quite a few in Nassau county.
    Get to a lawyer and be sure he. Knows what to do to safeguard your eights!

    DO NOT LEAVE OUT THE POLICE DEPT.
    Suffolk county PD is rife w corruption. If you have sufficient damages, file a notice of claim through a lawyer. There is a modicum of proof they need. I truly doubt they took the time to ask even one of the questions they should have asked, such as when she heard your voice, the time and date of the call, cross checking her records for the call,
    A lawyer will add your husband to the complaint and subpoena his phone records email text messages etc.
    he might even report this if what you say is true to the federal US ATTY. who's been investigating this dept.
    There is no requirement your case be proven beyond a reasonable doubt. By a preponderance of evidence standard and with some decent lawyering and detective work you may prevail.

    This is a closer question than it seems. In NY one can generally not record another in an area that a reasonable person would consider private. Normally a bedroom fits the bill, except here, the room is not delineated nor does it seem to have the same privacy value. I think he is out of line, but this is an issue you need to look at and to seek a legal opinion which may be different if you ask different lawyers.

    You are not very forthcoming with information but I will assume a few things. You reported a cop through 911 and the cop found out and he or his buds threatened you and now you are afraid to go further and you are afraid to go home less they come for you.

    Go see a civil rights lawyer in the biggest city close to where you live. Explain your issue. That lawyer, if he is a good civil rights lawyer he will know exactly what he needs to do to help you. Do that before you go to the Chief.
