    Once you have had the criminal charges dismissed yes you can sue. You should send in a notice of claim. Sounds like you need a criminal defense/ Civil Rights lawyer. I know quite a few in Nassau county.
    Get to a lawyer and be sure he. Knows what to do to safeguard your eights!

    DO NOT LEAVE OUT THE POLICE DEPT.
    Suffolk county PD is rife w corruption. If you have sufficient damages, file a notice of claim through a lawyer. There is a modicum of proof they need. I truly doubt they took the time to ask even one of the questions they should have asked, such as when she heard your voice, the time and date of the call, cross checking her records for the call,
    A lawyer will add your husband to the complaint and subpoena his phone records email text messages etc.
    he might even report this if what you say is true to the federal US ATTY. who's been investigating this dept.
    There is no requirement your case be proven beyond a reasonable doubt. By a preponderance of evidence standard and with some decent lawyering and detective work you may prevail.

    This is a closer question than it seems. In NY one can generally not record another in an area that a reasonable person would consider private. Normally a bedroom fits the bill, except here, the room is not delineated nor does it seem to have the same privacy value. I think he is out of line, but this is an issue you need to look at and to seek a legal opinion which may be different if you ask different lawyers.

    You are not very forthcoming with information but I will assume a few things. You reported a cop through 911 and the cop found out and he or his buds threatened you and now you are afraid to go further and you are afraid to go home less they come for you.

    Go see a civil rights lawyer in the biggest city close to where you live. Explain your issue. That lawyer, if he is a good civil rights lawyer he will know exactly what he needs to do to help you. Do that before you go to the Chief.

    The court permitted the case to be filed without payment of the filing fee and RJI Fee but will not permit the summons issuance until the plaintiff proves he is too poor to afford fees.

    These types of "inbetween" cases are often fought by your State Attorney General. Also you may not be speaking to the "right kind of lawyer" go to Northwestern Law School or Univ. Of Chicago Law schools which both have great clinics and that take cases so their students can get litigation/courtroom experience. These young excited lawyers bring a lot of energy to a case.

    I disagree w attorney Brosnan above as it is completely possible in NYC for a felony Robb to be reduced to a violation. Call tour criminal court attorney and ask him or her to tell you what you are charged with .

    No. Missing or not filing hour appeal is not exhaustion it is a waiver and you cannot proceed. Get to a lawyer and see if there is a saving statute or case law that can restore your case.

    May have to place a restraining order to keep someone at bay from a family member. Will that affect their future application for residency. I'm trying to keep them at bay temporarily but do not want to cause long-term damage.

    I mildly disagree with the above learned counsel, i believe any negative court action will negatively effect an immigration request. How much so depends however given recent events it may be far mire difficult to gain citizenship than in the past. Maybe engaging a family lawyer to mediate the situation is a better idea.
