    Your fees need to reflect those as outlined in the New York Worker's Compensation Fee Schedule. If you do not have this FS, you can contact an attorney who handles PIP arb/lit and if you provide us the CPT codes, we can provide you the information you are looking for.

    I agree with the prior response. Ask your attorney for a breakdown of the expenses to date. You don't have to wait until the end of the case to get that information.

    If you did, in fact, settle (signed release, received money), then you should find a lawyer who expressly deals with suing for No Fault benefits. The reason your lawyer didn't want to sue/arbitrate while your case is pending is because any negative decision would impact your injury case.

    No-Fault, or Personal Injury Protection (PIP) is the insurance coverage that protects you after a motor vehicle accident. If you read your insurance policy, PIP covers necessary health care expenses, medical mileage, home care and lost wages. A law suit for pain and suffering is what you bring against the other driver for injuries resulting from the driver's negligence. They are two very different insurance coverages.

    You should still receive wages from 9/1 - 9/15. Make sure you provide a copy of any denial the insurance company sends you to your lawyer. Good luck.

    I doubt any arbitrator will agree to hear your lost wage claim while your injury lawsuit is still pending. In my extensive experience, arbitrators will dismiss the claim without prejudice for you to refile because any decision they render MIGHT have detrimental effect on the injury case. Good luck.

    Ask the insurance company to prove it mailed you the cancellation. If they can't, send a complaint to the NYS Department of Financial Services. You can write your complaint and submit it online. Good luck!

    Have you tried to obtain a receipt from the place that provided your glasses to you? If not, your lawyer should obtain an estimate for how much the frames and lenses cost and supply to the insurance company.

    No intent is required in a negligence action. The plaintiff has to prove that the defendant breached a duty of care. You should speak to a lawyer in person who can defend you if you receive a law suit.
