General rule of thumb. 2 ounces of said alcohol within a two hour period will render a 150 lbs person impaired for at least 2-3 hours after intake. You need to hire a lawyer who handles sex crimes AND understands the SORA statute. He needs to demand a rehearing on the SORA finding. Public defenders are usually hard working and knowledgable lawyers.

Generally, it is a combined duty and the type of evidence makes a difference as well.. If the client is incarcerated. Or incapacitated, the attorney will carry a heavier burden but the responsibility to pay for evidence collection falls 100% on the. Client"s shoulders.
I usually ask clients to provide case facts witness names addresses and phone numbers as well as documents that they have or could easily obtain. I ask them to provide an investigation fee and I hire a private investigative team (I use Insight Case Management in NYC ) to canvass for witnesses speak to known witnesses obtain photos or other physical evidence. I will visit crime and accident scenes with them often 3 or more times before I conduct hearings depositions or trials.

Do not worry about whether he gets arrested or convicted, its' not in your control. The reactions of others are not in your control, the decision to report is yours and if you do it, do it for your sanity and your health. Do it so you can take a step to protect yourself.
