  • Can I sue the supermarket for injuries to my son's hand?

My son, 14 years old, was in the supermarket with his grandparents. He went to pour himself soup from the self serve station. The station had a caution hot sign for the top plastic piece of the soup barrels indicating that the plastic piece gets h...

    Jeffrey’s Answer

If the station was known and accepted to be hot, ergo the soup is going to be hot. At least that will be the defense. You should speak with local/qualified counsel asap. Do not speak with the store's people. Possibly, a case against grandparent's for lack of supervision (does CA recognize this as a proper cause of action). Most importantly speedy and full recovery to him. Get him appropriate medical attention asap. Goodl uck.

These are easy questions to answer. Anywhere from zero to seven figures. Depends upon whether you can "win" liability, the extent of your harm, prior history, and a whole lot more. If you know you need a lawyer, then you really shouldn't be fishing here. Good luck.

  • Why do i have to pay back ins. hospitals, medical out of my claim when it was not my faught

getting a small claim and deductables are taking most.

    Jeffrey’s Answer

The rational is because they paid on your behalf so they deserve to be made whole. Among the flaws in this reasoning is that you are the innocent victim and someone who was at fault would not have to pay money back. Another is that they contracted with you and accepted the risk. Plaintiff's lawyers and organizations tried to overcome this. This became the "norm" when Bush 43 was president and instituted changes in "fair play".

He should follow-up with medical treatment, if injured and he should speak directly with local/qualified counsel. He should also report this to his insurance company and he should not speak with anyone attached to either of the other vehicles.
