Our office offers a lot of traffic related services in addition to defending and fighting speeding, moving violation, and auto crime cases. We also represent persons before the NYS DMV in administrative proceedings such as fatality hearings, medical reviews, and also offer a remediation service whereby we remediate driving records for one reason or another by reversing convictions. That was the service we provided this client. Without realizing the insurance ramifications, he mailed in a speeding ticket with a plea of "guilty," believing the fine would be the only economic implication. However, this recording of a guilty to speeding caused his insurances rates to skyrocket by thousands of dollars a year for a 3 year period. We commenced a special proceeding and vacated (erased) his plea of guilty, and re-plead him to a parking ticket that does not cause the same insurance increase. And there is NOTHING the insurance company can do about it, except refund him his previously paid insurance surcharge.
