  • Got charged with 509.6 for fake ID at a concert in Darien Lake, N.Y. What are the chances of getting it plead down?

I didn't use the fake ID I did have in my wallet. I am 19 and a friend got me a beer. A security guard asked me for my ID and I was actually giving him my real one, when he saw the fake licence. He took my wallet to a police officer who gave me t...

    Michael’s Answer

You don't even know how bad it is. If you plead guilty you will lose your license. And "see the prosecutor," no, you are not going to "see the prosecutor," you are going to conference the matter with your advisory. You are in a venue as a kid whereby a lot of very smart and aggressive people who do not have any concern about you are in charge of. Doing this yourself is like leading the sheep the slaughter. The only thing the prosecutor respects is strength. Since you have none, you are going to get swatted around like a cat swats a mouse. Do yourself a favor, call your parents and have them retain a lawyer for you. You have no idea of the long and painful road ahead of you if you go in their exposed.

  • Question pertaining to getting my license back. It has been suspended for a year due to a DWI.

Hello, I was able to revoke my license today, but the DMV needs an interlock release form from the county clerk where I went to court. I did check to make sure I had everything they needed, so this came as a bit of a shock. I am getting worried no...

    Michael’s Answer

I am sure your lawyer was a very good attorney, but most DWI lawyers do not understand the regulations regarding the interlock. You need to find a lawyer that knows the regulations and can deal with the DMV and probation on this matter.

  • Got a 5 points tel use ticket in NY on my NJ driver license, how many point will be transferred from Ny to Nj license?

I was using my phone to ask my friend for help since I'm pregnant with my twins and I wasn't feeling well and got a ticket for cell use.

    Michael’s Answer

It's not about the "points" that transfer but the underlying CONVICTION that transfers which your insurance company sees and then surcharges you. It's a complex matrix too involved to explain here with any degree of simplicity. You should call a NY speeding and traffic ticket defense specialist.

  • Friend failed to appear to court to settle traffic ticket.

Hello there! A friend if mine has been issued a warrant because they haven't appeared for a court summons. I wanted to know if there is a possibility to defer the court date for such an issue.

    Michael’s Answer

There is an arrest warrant. You can defer until all of perpetuity - or until a police officer runs his pedigree. Whichever comes first.

  • What to Do if the Prosecutor is Mistaken (or possibly just lied) About the Points on Traffic Ticket You Will Receive?

    Michael’s Answer

What can you do - you can quit your whining. The prosecutor is not there to be YOUR advocate, he's there to be the STATE'S advocate. The prosecutor's client is the state, not you. This is what you get for thinking the process is easy and not retaining counsel. You want to "play lawyer" then proceed at your own peril. The prosecutor was not there to be nice to you and listen to your stream of consciousness. He made you an offer and you did not have to accept it. You could have set it down for trial. It sounds to me like the prosecutor played you because he knew you were weak and did not know what you are doing. The lesson learned is that you can't do a lawyer's job next time break open the piggy bank and retain counsel. Which you should to to commence a coram nobis proceeding, i.e., "change my plea." Which I think by now you realize is not as easy as it looks.

    Michael’s Answer

The information you are seeking is what we sell. This is a place to ask questions such as "what are the consequences if I plead guilty...what can a lawyer do for me that I cannot do for myself...." that sort of stuff. You are asking questions on how to litigate your case and do discovery and disclosure. Sorry, either retain counsel or hit a law library and figure it out yourself.
