I have a job and they want to promote me. In order for me to move up I need my license. I have been paying my child support since I started working. I never had a license before.
If you mean a restoration of your driver's license privileges, you may fill out & submit this form: https://www.childsupport.ny.gov/dcse/pdfs/dmvChallenge.pdf. Under what circumstances can the primary parent request additional support? Is it every 2 yrs that they can ask for more money? Doe child support ends at the age of 18 or 21?
It is NOT "every 2 years" - I thus disagree with the other counsel who chimed in (perhaps just a typo on her part). The law is generally one may modify child support: (a) once every 3 years, (b) if there's been a 15% change of income since the last order was set/modified, or (c) there's otherwise been a substantial change of circumstances. Additionally, child support in NY ends at age 21, unless sooner emancipated or extended by agreement. Call a Bronx Child Support attorney for more info.See question

If he's the one moving, generally any visitation he gets he'd need to pay for the transportation. As for summer visitation, there's really no basis to request any additional visitation over-and-above what he receives currently for the summer. Of course, the schedule may be amended somewhat, but that doesn't necessarily equate to him getting most or all of summer. As to whether you've qualify for spousal maintenance (i.e., alimony), you can utilize the court's maintenance calculator: http://www.courts.state.ny.us/divorce/calculator.pdf. As there are numerous factors which must be assessed as to whether you'd received maintenance at all, however, or for what duration of time, you'd benefit from having a consultation with an attorney. Thus, call a Bronx Divorce to schedule an appointment for a full assessment.See question

All one needs to set forth a basis to modify visitation is to state a "change of circumstances." Child support modification is slightly different, in that the standard is: 3 years have passed since support was set or adjusted, there's been a 15% change of incomes, or there's otherwise been a "substantial change of circumstances." Thus, the inquiry as to whether there's a basis to modify on either issue will be assessed on the situation as it exists at the time of the filing. At the preliminary proceeding, the Judge usually ensures service was properly made, whether the parties want assignment of counsel or an adjournment to hire an attorney, and assess the need for assignment of an attorney to represent the child(ren). Generally this would not be considered acceptable. Thus, I'd advise to keep a careful paper-trail & ask your ex if it's true, and if so, that he'll need to immediately purchase a separate bed. Call a Bronx Child Custody attorney to schedule a consult for a full assessment.See question
My ex lost his job and filed for downward modification...he then withdrew the petition without letting me know nor did the court alert me. Can I claim damages?
As it was presumably withdrawn without prejudice, he can always re-file. In terms of "damages," you can try filing a motion for sanctions and/or counsel fees. Call a Westchester Family Law attorney for more info.See question
