Lorne v. 50 Madison Avenue LLCA unit owner sued the board of directors for failing to remediate a construction defect. A unanimous Appellate Division dismissed the condominium board from the lawsuit determining the sponsor was the proper party for the lawsuit.
Hartman v. GoldmanAdam Leitman Bailey, P.C. won a Decision and Order granting summary judgment to the insureds. ALB P.C. effectively argued that anything planted along the fence were de minimis pursuant to RPAPL 543(1),and must be deemed to be permissive and non-adverse.
