Did he sign the birth certificate, or is there an order of paternity establishing him as the child's biological and legal father?
If no to either of those, he will first need to establish paternity.
In regards to custody, I don't think a judge will find it to be in the child's best interest that the father have any form of custody. however, he may be granted visitation rights (supervised or otherwise).
