    You can file documents on your own, and then pay a process server to serve the documents on your husband. Search your local court's website for fees.

    That being said, this approach may cost you in the long run. It is always best to hire an attorney to handle your divorce for you. This way, you can avoid mistakes and delays.

    Out of state visitation and custody will vary per case. Your husband has to review his current agreement, because there might be language regarding long distance moves from either party. The current order will need to be modified.

    Hire a lawyer to file a Summons on your behalf. They will be able to take care of serving your husband in jail.

    If the inheritance is in your name only, then it is your property. She doesn't have a claim to it. You can file for divorce.

    I would suggest depositing it into a separate bank account that she doesn't have access to.

    You might be able to get him to pay your legal fees, but not on the grounds of infidelity. He would need to make significantly more money than you, or have financially supported you during the marriage.

    NY does not have jurisdiction over the child, since the child was born in Florida, and has resided there since birth.

    Did he sign the birth certificate, or is there an order of paternity establishing him as the child's biological and legal father?

    If no to either of those, he will first need to establish paternity.

    In regards to custody, I don't think a judge will find it to be in the child's best interest that the father have any form of custody. however, he may be granted visitation rights (supervised or otherwise).
