  • Who do I go to for advice at this point? Family Law or Legal Malpractice atty.?

My divorce attorney mishandled my case which resulted in a loss of at least $30,000 in support for me. After I negotiated my own settlement with my ex husband, my attorney sent a final bill to me of over $16,000 when he had already been paid $25...

    Adam’s Answer

Unlikely that he waited. If you are concerned about the Statute, consult with a local lawyer. It would appear that you have reached an impasse so he sent you information about fee arbitration. This is a cheaper process and in some states, it is mandatory. Seek a malpractice lawyer in your state to explore your rights.

  • Can me or my friend be charged later on for hit and run since he left the scene of the accident without calling for the police?

A friend of mine drove my car one night and lost control then hit property on the side of the road. He left the scene of the accident leaving behind the car's license plate but told me when I saw the car the next day that it was hit overnight by s...

    Adam’s Answer

you might be charged since it will be presumed that you were driving at the time. Your friend should have reported the accident. I would inform anyone who inquired who the actual driver was.

  • Can I get a transcript of a judge's conference call with attorneys?

I had a lawyer representing me in a DCPP case, and after some time I realized that he was withholding important information and communication from me. He claimed that the judge refused to give us more time to get our expert to finish an evaluation...

    Adam’s Answer

Probably not. Generally conference calls are not on the record and therefore will not be recorded. Only formal proceedings are usually recorded. If you believe that a lawyer has been untruthful to you in the representation, and it was material, then you should contact the state board of bar examiners or local district ethics committee

  • Dental Malpractice

I contracted a very fast moving infection while out of the country for only two days (but, it was India.) It localized in my mouth, specifically in my gums. I was in pain and saw an oral surgeon that I was sent to by a friend. He told me I need s...

    Adam’s Answer

maybe, the best way to determine this is an in-person consultation. Normally these cases are taken on a contingent basis, so there is no cost in asking or having the case reviewed. Initally the lawyer will look to see if the case has merit in his/her mind. However, it really must be reviewed by a dentist hired as an expert to see whether there is truly a deviation from the standard of care. Also, while you were damaged, there are issues as to whether the value of the case would warrant the expense of pursuing it. Many times, the cost of pursuing the case weighed against the potential outcomes and the attorney's costs in pursuing the case make the cases not feasible. This may be that situation. However, the best determination is with local experience Med Mal attorneys who can address those issues for you.

  • Can police help to collect money judgement?

I won a case in small claims court (security deposit). I contacted the defendant asking when she would mail me a check but I did not get any response.

    Adam’s Answer

You need to docket the judgment. Generally speaking the police do not enforce judgments, but assets can be seized. The bet way to do this is to check with a collections lawyer.

  • Doesn't the court have to grant or deny my Order on a Cross Motion?

I opposed summary judgment & filed a cross motion for summary judgment and dismissal. The court granted plaintiff's motion, but failed to sign and stamp my cross motion as denied. Is that typical? Seems my motion should still be officially deni...

    Adam’s Answer

If the Cross-motion was properly filed, then the Court should have signed the order with a denial. As a practical matter it really does not matter as the plaintiff's order necessarily negates the relief you requested. It is not as if he would have granted yours if it was the same issue.

  • I was accused of hitting a parked car on private mall parking, they said I can be charged with hit and run. Do I have a defense

    Adam’s Answer

While it may seem minor this can be a big deal. I suggest that you hire a lawyer. The version you are giving seems like a set up. You need someone to make sure htat you do not have a large fine or lose your license for leaving the scene or hit and run.
