Cases are won or lost by preparation and hard work, not silk suits and shiny shoes. The ancient Chinese general, Sun Tzu, said it best: “Supreme excellence consists of breaking the enemy's resistance without fighting.”This is why preparation in legal matters is key. If an attorney doesn't learn all the facts, if he doesn't master all the details ahead of time with the intent of taking the case to trial, then his client's cause is a failure in advance.
Far too often, I have seen cases handed by so many different people in a firm, that no single person truly knows whats going on. That never happens in my law office. From beginning to end, I handle your case. From start to finish, I memorize every fact and detail. From the day you walk in my door to the very first day of trial when opening statements begin, I am the one who masters your legal matter. If your own attorney doesn't know what's going on, how can he ever persuade a judge or jury to take your side?
Lawsuits are won by workhorses, not show-horses, although it doesn't hurt to be a show-horse, either. Abraham Lincoln said it best: "[a]nd yet, there is not a more fatal error to young laywers than relying too much on speech-making. If anyone, upon his rare powers of speaking, shall claim exception from the drudgery of the law, his case is a failure in advance."
As somebody with over 10 years of experience in high school and intercollegiate debate and public speaking tournaments, who was former Captain of my Law School Moot Court Team, member of the ATLA Trial Team and earned the highest grade in advanced trial advocacy, I welcome and cherish all opportunities for trial and the opportunity for presenting your case in a public forum.
That said, nothing is more crucial than hard work, long hours, intense research and laborious preparation. Without hard work, an attorney's feathery clothing, flashy neckties, and flamboyant behavior are nothing more than fruitless, forlorn posturing, attempts to distract from the weaknesses of one's own case.
