Description: Plaintiff argued in response to the defendant's appeal that the trial court had properly denied defendant's notice of motion for reconsideration because it was not filed timely. Plaintiff further argued that the defendant did not provide a controlling decision which would have required the trial court to amend its prior decision and that the defendant did not provide any evidence to support his claims that plaintiff's calculations were in error. The Appellate Division agreed with the plaintiff's argument and therefore affirmed the decision of the trial court denying the defendant's application.
