Robert C. Brady concentrates his practice on business litigation. His practice has a particular emphasis on representing large franchisors and licensors in commercial disputes, trademark litigation and enforcement of franchise and license agreement obligations. Additionally, Mr. Brady has extensive experience in litigation involving covenants not to compete, and confidentiality provisions. He often litigates matters involving partnership and shareholder disputes (including oppression and dissenter’s rights cases). Mr. Brady is also well versed in financial services litigation focused upon the Fair Debt Collections Practices Act (“FDCPA”), Fair Credit Reporting Act (“FCRA”) and the Truth in Lending Act (“TILA”).
A member of the New Jersey, New York, and Pennsylvania Bars, Mr. Brady has participated in trials, appeals, and hearings in both state and federal court throughout the region. Mr. Brady regularly appears in New Jersey's Chancery Courts including expedited litigation and injunction proceedings. Mr. Brady is also experienced with arbitration and mediation proceedings before the American Arbitration Association and similar dispute resolution bodies.
Mr. Brady is a Master in the John C. Lifland American Inn of Court. Mr. Brady has been recognized by the Super Lawyers as a Rising Star and by Benchmark Litigation as a Future Star. Mr. Brady serves as an adjunct professor of law at Seton Hall University School of Law, where he teaches appellate advocacy. In 2007, Mr. Brady was a finalist for the SBA’s Adjunct Professor of the Year Award. Mr. Brady regularly speaks at continuing legal education seminars on issues related to franchise law and civil procedure.
Prior to joining the firm, Mr. Brady clerked for the Honorable Joel A. Pisano, U.S.D.J., in the United States District Court for the District of New Jersey and the Honorable John E. Keefe, P.J.A.D., in the Superior Court of New Jersey, Appellate Division.
