    John’s Answer

No, debtors prisons were abolished almost two hundred years ago. It sounds as if you have a judgment however, you should speak to a qualified attorney about enforcing and collecting on that judgment, rather than pursuing imprisonment.

  • My husbands attorney insisted he take the stand in his first degree murder trial.

I have two letters from his attorney highly recommending he take the stand in his own behalf, turns out it was the worse possible thing he could have done. Four words got him convicted, " yes I was there", this was 27 years ago and he is still in ...

    John’s Answer

Without knowing the full facts and information on this case, and what led the attorney to make that recommendation, it's hard to give you a fully informed opinion. I agree with the previous attorney, there are Innocence Projects in your state who amaze me with their passion and their selflessness and their astute legal skills. I would focus on getting him exonerated rather than pursuing vengeance on a call made by your husband's attorney. Best of luck.

    John’s Answer

Check the terms and conditions of the websites/forums that this person is harassing you on, and see if they can assist in identifying this anonymous stalker. It sounds as if you would need to first identify this individual before you can consider a cease and desist. Most attorneys do not charge for the initial consultation or offer a discount on that. It may be worth your while to speak to one about this before further damage to your reputation gets done.

  • Can I cash a check written in my deceased fathers' name?

Recently we had our pipes burst and as a result the insurance agency cut a check. However, the check came in my deceased fathers' name. As I am the beneficiary of his will, am I allowed to deposit that check into my account?

    John’s Answer

No, you cannot. The check should go into an estate account set up for the purposes of administering and disbursing your deceased father's estate.

  • I have recently gotten a judgement against me from a credit card company. Can my IRA be frozen/taken

I'm 62 and on SS with no other income. I do have an IRA that I don't want taken from me as it's all I have for the rest of my life.

    John’s Answer

I concur with my colleagues. An IRA would be an exempt asset. You sound rather judgment proof, so you might be able to make a favorable deal with the creditor and get the judgment settled.
