  • Can an American living and working in Japan sue a Japanese dentist? Are the costs of such a suit prohibitive?

My sister has lived and worked in Japan for 6 years, and receives medical/dental coverage through Japan's national healthcare system. Dental work on her teeth has been incomplete and inefficient, and major areas of concern have been ignored while ...

    John’s Answer

She may. You would need to consult a dental malpractice attorney in Japan for a better idea. From what I understand, suing a party in Japan is extremely expensive for those residing in Japan. For those out of country, I imagine the costs would be double that.

  • If my dad left a will that made myself and my sister co-executors of his estate, but on his bank accounts he had me as Joint

Owner, then do I have to claim the money on the estate or can I transfer the accounts to my sole name?

    John’s Answer

I am assuming this is JTWROS rather than a joint tenancy in common. Assuming if that is the case, you can transfer the account to your sole name as a joint account holder.

  • As beneficiary, will I pay income tax on the RMD from my deceased father's retirement account?

My dad died this year at age 90, before he took his RMD. Thus I made the distribution from my inherited account to a taxable account. Will I pay income tax on this RMD even though it was my dad's RMD and not mine?

    John’s Answer

This doesn't make sense at all. How could your father have taken the RMD if he pre-deceased the act of the RMD? Death would negate the schedule of required minimum distributions as there simply is no more life expectancy (of which RMD tables are based on). Are you talking about a beneficiary payout? If so, that will be income taxable and possibly subject to estate tax. You should speak to a qualified accountant about minimizing such taxes or setting up an inherited IRA that can minimize taxes over your lifetime.

Also, would the police try to deliver it via another method?

    John’s Answer

Ms. Holton brings up valid points. There appears to be more to this than meets the eye.

    John’s Answer

Sorry to hear about this, but this will be a difficult case to prevail. However, Internet law is changing as regulations are starting to catch up with those who have taken advantage of that disconnect.

There are a lot of facts you present that are disturbing, and we certainly do not have all the facts. You present this in a legal forum and I do not understand what your legal question is. If an investigation on your spouse has taken place already because of her accusations, then he will need to get a criminal defense attorney. Or are you asking for just general help for your daughter? It sounds like she is highly manipulative or she really was abused. Children, especially at that age, do not just suddenly engage in sexually advanced behavior - that is learned, but from whom? It sounds as if the services of a family and/or an adolescent therapist could be quite useful. They may be able to get to the bottom of your daughter's behavior, and provide you all with answers. I wish you the best of luck..
