    It's always possible that the judge may take pity on her, but for 350.00 I think it's a waste of time and losing work is worse. Often the courts are very stringent about allowing the waiver as well.

    It is unlikely that any specific medication will be itemized or specified in the calculations of your settlement other than a surgical intervention need or maybe a specific expensive cortical steroid for some permanent lung conditions, as we have seen from our experience. However it can factor in as future pain and suffering and future pain medication. You should sit down with a personal injury attorney and talk in greater depth with them.

    The creditor can only go into your account with either authorization by you the debtor or after judgment, obtaining a bank execution. If you are dealing with a payday loan however, all bets are off. Don't ever ever use a payday loan.

    In my opinion, you definitely need a workers compensation attorney. You can check avvo to find a good workers comp attorney that focuses on that area of law. The consultation should be free.     You can file a pendente lite motion for possession of the residency and get a hearing before the divorce or you can ask them nicely not to copulate in your shared home, or you can move out.

    I was awarded a judgment in 2006, the defendant started paying and stopped. The last payment was received in June of 2006

    You should consult with an experienced collection attorney as soon as possible. There is a 10 year statute of limitations on a judgment which means you are running out of time to collect. A collection attorney, like myself, will often do an asset search and research the debtors job to determine which way to collect would be best. My office will usually attempt to obtain a wage garnishment, a property execution, or a bank execution.

    Your question is entirely unclear. Is the other driver your mother? Or is the other driver someone who caused the accident unrelated to you? If the car was totaled due to the negligence of another driver, you may have a claim against them for your property damage.
