I am on unsupervised probation, I made a payment plan agreement. It started in November and I paid November but I miss December. Well I get violated or do I just continue making payments this month of January
The short answer is it depends. Failure to pay is a technical violation. The real answer is that it depends on your probation officer and your relationship with him/her. Usually, if you don't have a prior history of violations, your probation officer will work with you to get you back on track. Of course there are exceptions to the reasonable probation officer.See question

A lawyer can stress to the judge that you had no knowledge and that other than this instance you have complied with all the terms of probation. It is up to the judge whether or not to keep you on probation.Your lawyer will ask for a final surrender hearing as probation violation allegations have two events. A full hearing with witnesses and documents such as the warrant can then be introduced before the judge.See question
