  • Must I notify biological father for my daughter's name change if DNA was established but hasn't been involved in almost 5 years?

Family law. Name change for a minor. Possible child abandonment.

    Howard’s Answer

Unless you are trying to keep the biological father from information, what is the harm, if there is harm then you should address that issue separately, I wish you all the luck in the world and I hope that you and your family are safe.

Yes, most legal aid attorneys are outstanding, they devote their own time, and very hard work to zealously advocate for those who need help, lawyers should not be judged by what they look like or who they work for for.

  • If the child was born before the marriage do you still have to complete the parenting classes before you get a divorce?

    Parenting Classes for divorce

    Howard’s Answer

It really depends upon your state and counties guidelines, most of the time if you are mature and have been blessed with other children they may waive the requirement, however if this is your first child then it doesn't really matte if the child was born before the marriage the court wants to make sure that both parents have a fair and basic understanding of the needs of a child and what is in the childs best interest, it is a win win all around, unless you are mature enough and the cost is high, the facts will dictate the outcome, no matter the divorce or not, as long as the child is healthy and happy all is good, take care.

  • I filed for a divorce after recording her with him. If the recording is inadmissible can I still file based on adultery?

I was told that I can't use the video because I'm not in it. It's the only proof that I have.

    Howard’s Answer

I am sorry that you are going through this, most courts especially in 2015 are not that concerned with what caused the breakdown of the marriage, adultery type issues usually are relevant for financial reasons if one spouse spend funds on their partner, that money may be considered a dissipation of marital funds and that is an issue, otherwise, sometimes it may be used for child custody matters, please chat with a local attorney and I hope things work out, take good care.

    Howard’s Answer

I am sorry that you are going through this difficult process, if the discovery process is still open and it is a valid request in your state it may be up to the court to decide whether it is relevant, they will weigh the probative value versus the prejudicial affect, however, it sounds like discovery should be closed given the timing, yet it may be able to come in under impeachment of a witness etc, take good care and I hope things work out.

    Howard’s Answer

I am sorry that you are going through this, I agree with both attorneys that hiring a local attorney in your area will help you, absent that, please use a licensed constable/sherrif/process server in that state who will confirm that it is the right address and provide good proof of service, you may have to use a private investigator as well if they cannot confirm the address, take good care.
