    If you truly have the children half the time and that was not the case when you were divorced you have a much better chance at modification.

    Without seeing the court order it is hard to give an answer.The new massachusetts alimony may give you some relief,buy not immediately.

    What if you are out of town and cannot be available until trial date?

    The other side is entitled to discovery.Failure to appear could lead to sanctions,including default or dismissal.Usually lawyers will agree to a date as convienent as possible.

    Quincy is a very busy court.The delay is not unusual,but you mighy want to check with the clerk's office to ensure there is no warrant issued.

    The QDRO was prepared by an attorney and now just needs to be filed...And, our divorce does not become absolute until October 28,2011... It was granted on June 29,2011...

    Usually you mail the original and a copy to the Judges attention,but some courts handle it a bit differently,so I suggest you call the Judge's secretary to make sure.

    If you have made reasonable efforts to locate him without success,the court will direct you as to what newspaper to publish notification to him.You must file the newspaper notice with the court as return of service.

    It would become a matter of credibility between you and your husband.You would also best be served by seeking legal advice as to whether an annulment,versus a divorce, would be the best choice.

    In a divorce,all assets are considered by the Judge,but are divided pursuant to a number of factors in the law,length of marriage being a very important one.We are not a 50/50 state per se,so the entirety of all circumstances must be taken into account.
