  • How long does it take an insurance company to accept liability for a slip and fall incident that was recorded on video?

    Karen’s Answer

An insurance company will rarely accept liability. They may offer a settlement. Typically, these cases are hard fought by attorneys in litigation before you get anything close to fair. You will want to consult with someone that is experienced in this area. You will have to prove that they either caused the dangerous condition or had knowledge (or should have had knowledge) of the dangerous condition in time to fix it. Sometimes, they claim a spill must have just happened right before you walked by because they always check for those things routinely. Thus, they claim they had not notice. Employees in depositions will typically not be favorable to the Plaintiff. They want to keep their job. The statute of limitations is generally three years. Hope this helps.

  • What type of case do I have?

    Karen’s Answer

Most homeowner's coverage will have med pay for your medical bills if you were hurt on the property. This coverage is typically anywhere from $1,000 - $5,000, typically, regardless of fault. If you were on the job, your bills may be covered by Worker's Compensation. If you are looking for pain and suffering compensation, that is a different story. If you were on the job, it is just a Worker's Compensation claim, unless you can prove fault of someone other than your boss, such as a ladder manufacturer. If you were not on the job, you need to prove that someone was negligent to be entitled to pain and suffering. Hope this helps.

  • A car hit my daughter. How do we proceed? Do we need an attorney? How much pain and suffering compensation should be?

    Karen’s Answer

Your daughter's case likely warrants an attorney in order to obtain a fair settlement and many personal injury lawyers will consult with you for free. You should schedule a consultation with a lawyer in your area before you communicate with any insurance company.
