  • What should we do when pd isn't doing all he should be doing? I want a second opinion. Please help

    Michael’s Answer

You can certainly fire a PD, or any attorney, and hire your own private counsel. It is impossible to tell if a plea is the right move for you son based on limited information here. And ultimately it is up to him. If you want or he want an second opinion you should consult with an attorney in person. Good luck.

  • Can I be charged with a DUI if I wasn't driving, I was parked on private property (the business called on me) and was harrassed?

    Michael’s Answer

As the others have said, you can be charged with anything at anytime. Being convicted is an other issue all together. You should speak with an attorney about the specifics of your case. Good luck.

  • I expunged my felony record in CA but I am still getting denied by DOJ to purchase a firearm.why?

    Michael’s Answer

Generally, a felony conviction is a lifetime ban on owning firearms under federal law. A state law "expungement" does not typically change that.

  • Can you visit an inmate with a restraining order?

    Michael’s Answer

If you are the protected person, the "restraining order" does not restrict your movement. However, if your husband is ordered to have no contact with you, he could be charged with violating the order if you go to see him or even speak to him on the phone, depending on the specifics of the order.

  • Is there any a search warrant can be fake?

    Michael’s Answer

I am not exactly sure what you are asking. However, I will take a shot. Yes, technically it is possible to "fake" a search warrant, but it is extremely unlikely. If a law enforcement officer was ever found to have forged or faked a warrant, he would most certainly lose his job and a whole battery of bad things would probably happen to him. Search warrants are fairly easy to get so a fake warrant would be exceedingly rare.
