  • I was hit by a big rig who got into my lane, policed ruled not enough evidence. My ins totaled car, what else can be done

    Robert’s Answer

I believe it would be best to contact an attorney for a free consultation and provide the attorney with a copy of the police report for review. There are many instances where the police report is inaccurate and facts/evidence within the police report will be used by your attorney to build your case.

  • Should i get a lawyer i was hit on a bike going through a cross walk by a car that took off?

    Robert’s Answer

You should contact a personal injury attorney as soon as possible. If you own a vehicle and have uninsured motorist coverage you may be able to recover under that policy. A personal injury attorney will help you with your property damages claim and your bodily injury claim.

  • AUTO ACCIDENT INSURANCE: I'm the injured party. I have the at-fault driver's insurance information and the vehicle owner's

    Robert’s Answer

You should contact a personal injury attorney and allow him/her to handle the claim process against any and all possible defendants. I would recommend that you avoid giving a statement to the insurance carriers and allow your attorney to handle the statements. Your attorney should also help you handle the property damages claim. Most personal injury attorneys (including our firm) represent accident victims on a contingency bases (that is, if there is no recovery, there is no fee). Most firms handle your property damages free of charge (including our firm). Your personal injury attorney will also order the police report for you and help you get the proper medical care (if needed). Please feel free to contact any one of the personal injury attorneys for help. Good Luck!

  • I was in a car crash 5 days ago i didnt have insurance.my car was totaled ,but the other driver was at fault.can i sue?

    Robert’s Answer

In California, if you were the not at fault driver, you may recover economic damages (e.g., medical bills, loss of earnings, property damages, etc.) but unfortunately you can't recover non economic damages., e.g., pain and suffering (Propesition 213). However, your son may be entitles to both economic and non economic damages if he was the passenger). I recommend that you contact a personal injury attorney as soon as possible. Most personal injury attorneys (including our firm) represent clients on a contingency basis. That is, if there is no recovery, there is no fee. Good Luck!

  • I was hit by a big rig and he was at fault what are my rights even tho i don't have a license can i still claim property damage?

    Robert’s Answer

Even if you didn't have your drivers license at the time of the accident you're still entitled to claim damages. Both for property and personal-injury. Contact a personal injury attorney as expeditiously as possible so that they can handle both the property damages and personal injury claims for you. Most personal injury attorneys (including our firm) work on a contingency fee basis. That is, if there's no recovery, there's no fee. Best of luck!

  • What compensation should I expect for accident caused by drunk driver?

    Robert’s Answer

To determine the amount of compensation that each individual may recover Will depend on the extent of injuries sustained by each Individual. It sounds like your parents sustained serious injuries. A personal injury attorney will need to review all the medical records and also determine if there will be need for future care/Damages. That being said, it is premature to put dollar amounts on compensation. It is Also important to find out the insurance coverage amount of the other party. If they have limited coverage, you will need to check if you have uninsured/Under insured motorist Coverage That is greater than the other party's. These details (as well ad many other details) will be explained to you by your personal injury attorney. Please feel free to contact any of the personal injury attorneys on this website for a consultation. Our law firm as well as many others do offer free consultation. Good luck and we wish your entire family a fast recovery.

  • We were at a red light and a drunk driver ran Right in to us

    Robert’s Answer

Make sure to seek medical care for your injuries. Your personal injury attorney will obtain the police report for you and establish liability. Most personal injury attorneys will also handle the property damages claim for you. The only thing you and your friend should be concerned with is getting medical treatment. You leave everything else to your personal injury attorney.

The statute of limitations in California for bodily injury is two years and for property damages three years. Failure to file suit within this timeframe will forever bar you from bringing an action.

  • I was a pedestrian walking in a cross walk and I was hit by a mini van , why mediation ,should be a open and shut case

    Robert’s Answer

Based on the information provided it sounds like the other party is 100 percent at fault. Is the other party's insurance carrier contesting liability? Are damages being contested? We definitely need some additional facts. What stage is your case in? Mediation is held to help facilitate settlement. Please feel free to contact our firm for a free consultation or anyone of the personal injury attorneys listed this site.

    Best of Luck!
