  • If I have full custody (legal and physical) can I keep a sick child back from visitation?

    Kevin’s Answer

No you must comply with the court orders. You can not unilaterally decide if the child does not go.

  • What can I do to stop this?

    Kevin’s Answer

If there is no specific time for you to call the children you should get a specific court order as to exactly when you can call and speak to them. 24 hour notice to speak to the children does not seem reasonable.

  • Can my ex get child support from me when he pays and has custody of our kids?

    Kevin’s Answer

Yes. He still owes the child support arrears from when you had primary custody. That does not go away. He can now request child support from you now that he has primary custody.

  • Can a divorce judgment e reopened if there is an extreme change in circumstances?

    Kevin’s Answer

The court retains jurisdiction over the issues of child custody and child visitation until the child graduates from high school or turns 19. Custody can be modified post judgment based on a substantial change of circumstances. You do not need a substantial change in circumstances to modify visitation. The court will generally require you to participate in family court services mediation prior to the court hearing.

  • What to do regarding plane tickets for kids back home when ex is supposed to pay for it?

    Kevin’s Answer

You are stuck between a rock and a hard place. If there is no ticket purchased for the child to return home then you can either purchase the ticket yourself and then go to court at some palter point and ask to get reimbursed. Alternatively you can go to court on an emergency basis and ask that the child be returned forthwith if the child is not returned when she is supposed to be.
