  • My husband filed taxes married filing separate because im on ssdi and i dont file. Will this hurt his greencard decision?

    Olga’s Answer

If you have sufficient evidence of your bona fide marriage, filing taxes separately could be explained in your situation. You can also choose to file amended returns as filing jointly for the past 3 years. CPA can assist you with the tax filing.

  • What should I do in this divorce?

    Olga’s Answer

You may be eligible for an innocent spouse tax defense. It allows to transfer tax liability to the spouse who earned the taxable income. Consult with a tax attorney about your situation and eligibility.

  • What should I do?

    Olga’s Answer

You can file your amended tax return as married filing separately. IRS would then recalculate your joint return. Based on your separate incomes, you would either owe tax to the IRS or could have a refund. I suggest consulting with a CPA about the amendment.

  • Can I re-submit my application while undergoing Administrative Processing?

    Olga’s Answer

If your employer's attorney is representing you, it is best to inquire with him or her. Otherwise, you may attempt to contact a U.S. consulate yourself or hire an attorney to represent you. It seam there were some issues in your case which resulted in an administrative review. It often takes a while but 15 months seems unreasonable.
