    Consult with civil rights lawyer privately to discuss the facts privately. Depending on the facts, you may have a claim. You need to move quickly, though, as there is a 6 month deadline to preserve any state claims.

    Write to your appellate lawyer. S/he is obligated to provide you a copy of your file. If the lawyer refuses, contact the CA Appellate Project that is supervising that lawyer and make a demand for your file. You can also request that they appoint a separate counsel to litigate the habeas matter if your appeal is still pending.

    You can get a copy of the minute orders for the cases to show that one was expunged and the other reduced. Send those to Dept of Justice to correct your record. Otherwise, you will need to contact a lawyer in the state you were convicted.

    I think Mr. Hill is referring to Penal Code 851,91 and it would be premature to file now unless it was dismissed with prejudice. You must wait until the statute of limitations have elapsed and the DA can no longer refile. You can also file a petition of for finding of factual innocence, but you'll need proof to establish your innocence. Best to consult with a criminal defense lawyer with experience with these kinds of motions. Many of us who do this work will provide a free consultation to discuss the options.

    First, call the lawyer who represented you to find out what she thinks is the best course. Other option is to call the PO and ask for additional time to complete the anger management class--if the PO has not already submitted a notice of violation, you may get lucky and get a second chance. Best to have a lawyer help you. Do NOT go to jail as suggested by another lawyer; doing so will only guarantee you spend time in jail.

    I agree with Ms. Henderson Mattern's answer and would add that the charge is a wobbler, meaning it can be filed as a misdemeanor or a felony. The DA will make the initial decision based on the facts and your niece's criminal record. Bail will be set according to the charge. She needs a good lawyer.
