    You need to include everything that presently exists. Let's say you have a very expensive watch that was a gift from a relative before marriage, you should list that and indicate that it is your separate property. If you have student loan debts from before marriage, you list those as well and indicate that they are your separate property. Of course, you also list all marital assets and debts.

    If the debts no longer exist, your ex can make the argument at trial that you paid off your separate property debts with community property and the community is entitled to reimbursement. This is somewhat complicated and you would both be best with a lawyer to guide you through the process!

    Yes. This code section means that you are required to bring your case to conclusion within five (5) years. Looks like you didn't do that? You will likely have to re-file a new petition, unfortunately, and start again. It is always best to have an attorney help you out so things don't languish in this way.

    I agree with the previous answers. When was the 5150 hold? How long was it? Were there unusual circumstances? If the 5150 issue happened 15 years ago (for example) and mother was temporarily broke and had both parents die unexpectedly, the court will react differently than if it occurred recently, repeatedly, and the issues surrounding the hold were not isolated events.

    I am handling a similar matter at present and it can certainly get thorny! While my colleagues are correct that these are rarely granted, I would seek out a good family law attorney but make sure they have experience in this area! For example, you likely CANNOT get sanctions under Family Code 271, because this would be a civil suit, not a family law action. You need to pursue sanctions under the appropriate civil law section. Further, I'd certainly recommend a CCP 998 offer (not available in family law, but available in civil litigation) and then try to force her hand by requesting a trial date.
