  • Can I sue Suffolk County for not having stop sign?

    You can certainly try, but it is usually costly and almost always would require retaining expensive expert witness to prove elements of your case against county. Be aware that if and when the county . city state or government agency is involved as possible defendant -there are significant shortening of dates and deadlines and requirement for notice / pleading and suit.     Adverse insurer, and even your own insurer in most cases will go with the Actual Cash Value and/or Fair market Value based on some sort of internal matrix that each company uses to calculate as total loss. Good that you have done your research because the only way I have found to get them off off their usual low-ball offer is documented hard facts - not based on guesses or emotions or even fairness as the usual total loss offer will not allow you to by the same car, or even close if you could find it - but supported hard numbers.     Need more information... Where, by what medium, and/or to whom did the church make false accusations? And, how did these statements damage your reputation.     Colorado Statute of Limitations is generally as follows: C.R.S. 13-80-102(a) (2009) - Negligence - Two years and SOL begins to run on date that both injury / cause are known / should / could have been known through reasonable diligence by alleging party; C.R.S. 13-80-102 - Malpractice - Two years - also beginning at time injury was or should / could have been discovered (with limited exception can not go beyond 3 years after injurious act). As for general and special damages, there is a tremendous amount of factual information that goes into calculation of damages.     Certainly there has to be paperwork and documentation - a ton of it I would only imagine for adoption of a baby of any nationality - setting our rights and responsibilities of parties.     You have rights and options. You entrusted your vehicle to the shop. With or without repairs, you did not entrust them with a totaled vehicle. Document everything as talk is cheap and a common form producing both delays and frustration on your part. Present your claims in writing to the business insurer for the garage, and they should be more than willing to write of the repair for a vehicle that they - employee or agent - wrecked. If there is an adverse driver and insurance that is admitting fault, follow that trail. If you had your own insurance also, get them involved to investigate follow up, and provide coverage if applicable - or move it along with the other party's insurer going forward.
