  • Given court citation for possession on marijuana in Iowa, what will I likely get?

    Sarah’s Answer

You should explore the possibility and requirements of a deferred judgment with your defense counsel.

  • What happens if I flee the country to a non extradition country? To avoid felony sex abuse charges?

    Sarah’s Answer

I want to add that if you flee, you will also end up charged with another crime once you are caught. More likely than not, your time evading custody will be ordered to run consecutive to or after whatever time you are ordered to serve in the felony sex abuse matter. In short, it will get a lot worse--not better.

  • Can I lower my aggravated felony to anything lower?

    Sarah’s Answer

I am sorry but no, you cannot have the conviction reduced. Your only option is by seeking and obtaining a pardon from the governor. You can read about that process by looking up Iowa Code Section 914. The governor rarely pardons anyone though but that is the only option for getting that conviction removed from your record.

  • How do I get my criminal record sealed?

    Sarah’s Answer

I am sorry to have to tell you this but there is no way to get your criminal record "sealed" in Iowa. There is also no way to get the information for these convictions expunged. The only avenue for you is through a pardon by the Governor. The procedure for that is found at Iowa Code Section 914. However, I do not encourage you to spend money hiring an attorney to pursue a pardon under the circumstances you describe.

  • Should I sign a contract, that a former family friend made up agreeing not to slander, bully, or harass her family anymore.

    Sarah’s Answer

No--definitely do not sign that. Also, stop communicating with them or about them. There is nothing but headache for you otherwise. Do not post on Facebook about this situation.

  • What is legal reason to fire a waitress?

    Sarah’s Answer

You can fire her for not performing her duties as directed. That is not an illegal reason to fire someone. I encourage you to create an employee handbook or have one created for you so your employees know what is expected of them and you can rely on it as a basis for terminating employees who don't meet those expectations.

  • Can employers make rules such as "if employees late for work, we are going to deduct their wages" or some rules like this.

    Sarah’s Answer

An employer must pay employees for time worked and it cannot deduct money for punishment but it can offer incentives like bonuses or premium pay as a reward for doing what it wants.
