    John’s Answer

    Many Courts in this area, including Lakewood Municipal Court., are reasonable and understanding in the appropriate situations. As the other attorneys have advised, you could initiate a request through your probation officer first, and if unsuccessful, retain an attorney.

  • My ex husband and I own a house together. My name is on the deed but not the mortgage. What is my legal right?

    I would add to the other answers that in the context of a divorce, how ownership is titled is not necessarily determinative on how the Court will handle this asset. The Court has the power to decide if the house is a marital asset and subject to division between the parties, or all or part be considered the separate property of either the husband or wife. If your question is in the context of a possible divorce you should consult an attorney to analyze this issue.

  • My medical insurance was dropped in June. Medical was part of my compensation. Am i entitled to money for loss of coverage?

    John’s Answer

    You would have a claim against your Employer if they promised you that your insurance would be maintained until a date certain and then failed to fulfill that promise. The same with the unpaid vacation. If your Employer denies making these commitments, there will be an issue of fact as to what was promised. You could also review company policies and past practices to try to establish such a claim. Additionally, you should have been afforded an option to extend you medical insurance through COBRA if you meet the requirements.

  • If someone borrow a item of mine and I've repeatedly tried to retrieve the item if they sell it is that illegal

    It may very well constitute a theft or conversion criminal charge with you as the victim, and some type of fraud charge as to anyone who buys the property. In a major city such as Cleveland, the police may not be that interested in this type of case. Some of the suburban police departments may be more receptive.

  • Will a house in a LIfe Estate that has been deeded to daughter in 1998 still go through Probate upon death of the mother?

    The life estate should extinguish upon the mother's death and there would be nothing to put through probate. There may be a need to file something with the County Recorder to document the death.

    John’s Answer

    Also, if you paid by credit card, the holder of the card can contest the charges with the credit card company and get them removed. Additionally, you could consult an attorney about other potential causes of action.

  • Is it against the law to record someone without their knowledge?

    It some states it is not permitted. I other states it is permitted but may violate certain telecommunication rules if there isn't a beeping sound.
