    No. In fact, if you are forming a "single member" LLC, an EIN is not required. Forming an LLC in Ohio can be done simply and on-line with the Secretary of State. That said, you should discuss your plans with a tax advisor and consider consulting a lawyer before you undertake any business operation, Of course, if the LLC will have more than one member (owner) you will require an EIN--after you form the company--and you should definitely work with a lawyer.

  • My fence is on neighbors property.

    You are responsible for a fence on your neighbor's property. You have recourse against the fence contractor, unless you specifically located the property lines which the contractor was to follow. If neither of you obtained a survey of the property line there is some question about shared responsibility. As a practical matter you should give the contractor and opportunity to correct the problem If the contractor declines, you may seek "cover" by finding an alternative contractor, having the correction made and bringing an action against the original contractor for the cost. You can probably do this yourself in small claims court at nominal expense. You may have to hire an attorney to collect on any judgment. Having said all this, you may want to consider consulting an attorney at the outset. Most of us offer a telephone consultation at no charge.
