  • My rep from pepsi has been sending me pics of his penis and trying to get me to have sex with him. Can I sue him & Pepsi?

    Russell’s Answer

If his actions are tortious and support a civil claim, his employer can only be held liable under limited circumstances as sending you pictures of his penis is outside the scope of his job. It sounds like a challenging claim. However, you can get an ex parte restraining order if he is stalking you - and after you get that you are entitled to attorney fees at the hearing on whether or not the court will keep the order in place.

  • How long does settlement check take to get to me?

    Russell’s Answer

That's a fair question, and you aren't "greedy" for asking or wanting to know what is going on. You deserve a better explanation than "still pending." There are many things that can delay payment of a settlement. There are processes the lawyer is required to go through with Medicare and Medicaid, and possibly other entities, all of which can delay distribution of proceeds. It is not abnormal for distribution to take months, depending on the circumstances. Your lawyer should explain the process to you so that you know what "still pending" means and what the process is going forward.
