  • Hi, is it possible to have an arrest of domestic violence removed from my record? It was thrown out but it still appears.

    Jordan’s Answer

    If it was a Domestic Violence, 3rd degree misdemeanor charge in Alabama that resulted in a dismissal, you may be eligible to retain our office to represent you in petitioning for an Expungement. An expungement if granted by the court would wipe out clear the record of arrest. There are certain criteria that must be met and we evaluate everything in a phone or office consultation.

  • Can I expunge a shoplifting misdemeanor off my record?

    If your case resulted in any type of conviction, your best remedy may be an application for full pardon under current Alabama law. Also, you may want to have any attorney familiar with post trial remedies in criminal cases review your case for any potential grounds to pursue under a post-plea challenge on the conviction in the trial court (again, if there are any potential grounds based on your case). We represent people through the entire pardon process in Alabama. Also our law office handles potential post-conviction challenges to convictions, where there are grounds. A caveat to the pardon process is: if your conviction(s) were in a Municipal (City) court, the Board of Pardons and Paroles holds that they do not have jurisdiction to consider an application for pardon from Municipal Court convictions. The Code of Alabama gives the Mayors of cities the jurisdiction to grant pardons in the respective cities.

    If toy do not qualify, was your misdemeanor in a district (not municipal) court in Alabama? If so, you may want to consider applying for a full pardon in Alabama if that remedy would qualify you then to be eligible to become a certified teacher.     You can contact the clerks office in Jefferson County and request a copy of your case action summary showing the case disposition. Alternatively, you can complete an ALEA criminal history application with the State of Alabama. If non conviction, possible Petition for Expungement. If conviction, possible application for pardon or if grounds, seek a possible set aside from court. All different possible remedies depending on the circumstances.

  • Is a 60 month suspended, split and flipped an illegal sentence ..

    By flipped, do you mean a reverse - split sentence? Probation on the front end? What was the spilt portion? 60 split 12 months for example? Alabama has a split sentencing statute that governs the terms of split sentences in Alabama. A sentence not authorized by Alabama law is an illegal sentence and can be challenged via a Rule 32 in certain cases with no time limitation because it is a jurisdictional ground.

    No convictions are currently eligible for expungement in Alabama. Arrest records for certain charges are not eligible for expungement even if the disposition is a non-conviction. A Trafficking arrest is not eligible.
