  • Do I have a case against the insurance company on a golf cart my daughter fell off as a passenger and broke her collarbone?

    Joseph’s Answer

There must be some negligence either on the driver of the golf cart, or improper maintenance by the owner of the cart for her to recover under a bodily injury claim against the driver/owner/insurance company that was a legal cause of her losses and injuries. She may be entitled to med pay benefits under the insurance policy as well, but those are a separate recovery. You should have an experienced personal injury attorney review these facts to determine what claims can be made.

  • my lawyer stated Geico agreed to settle for the full amt I am waiting for a release and check wasnt given timeframe what do I e

    Joseph’s Answer

As Mr. Tischhauser advised, your lawyer should be answering that question for you. There is no reason for them not to give you a generally expected time frame for receipt of the release and settlement proceeds.

  • What is a fair settlement?

    Joseph’s Answer

There is no way to properly give you a valuation on your case with just the information you provided. This is not a forum that can provide such information. Only an experienced attorney familiar with all the facts of your case, including your complete medical history should attempt to place a valuation range on this. Hopefully you have counsel and can have them provide this information to you.

  • If I was in a accident with no injuries am I entitled to a payout?

    Joseph’s Answer

No, it's not too late to seek care for your pain. It's also not necessary to go to a hospital to do this. You can go to a clinic or any doctor of your choosing to discuss the problems you are having and the plan for treatment. It would be wise to also consult with an experienced personal injury attorney as well to seek guidance on pursuing any claim against an at fault driver. There is no cost in doing this and it protects your ability to pursue any viable claim you may have.

  • My 6 year son got hit by car while he was picking tennis ball on road in front of my house.

    Joseph’s Answer

I changed the practice area to Personal Injury. You may have a claim on behalf of your son, but these "darting" cases are very difficult. They depend very much on the individual circumstances. An experienced personal injury attorney can evaluate the facts for you and help you decide if this is a claim that should be pursued. The officer is not the one you should rely on in making that determination for a number of reasons.

  • Can me or my representative request a supermarket in FL to provide copies of my recorded statements in a slip and fall claim?

    Joseph’s Answer

They do not have to provide you with a copy of your statement if you haven't filed suit. If you have a lawyer, he should know how to proceed. He will likely ask for it to be produced prior to suit. They may elect to do so, or they may not. Please consult with an attorney regarding the procedures involved in pursuing your claim.

  • How long does it take for an attorney to negotiate medical bills down on an auto accident case that was settled 4 months ago?

    Joseph’s Answer

This is why you have an attorney. You do not negotiate medical bills, they do. If you have a problem with the time it sometimes takes to do this, you should discuss it directly with your attorney for specifics on how much more of a reduction she believes can be obtained by continued negotiations. If that figure doesn't match your time/value assessment, then simply tell her you're fine with what has been done already and she can just disburse now. If Medicare or Medicaid are involved, it can take longer than the typical time for reductions.
