    My experience in Tampa has been that in 4 months I already get an interview date, but it may not be anythign to worry about. Just go to the website. If it bothers you too much you could get an infopass appointment.

    Please remember that not only are they looking at how long you've stayed ( trips have to be less than 6 months) but they are also looking at how many months OVERALL you are staying there as compared to the US. Eventually even if you come every 6 months, it will catch up to you and they will realize that you are no longer " living " in the US.

    A re-entry permit may not be extended. So you have to come back to the US if you don't want to lose your green card. You can petititon for your wife but there is a wait period of more than 1-2 years.

  • I manage an essential function of the business but only manage subcontractors. will I qualify for EB1-C?

    Yes, I do believe you qualify: EB-1C is if you are going to work in a " managerial or executive capacity adn with the same employer". So as long as you are managing subcontractors, I would say you are in a managerial capacity. The law doesn't specifically say WHO you have to be managing ( or that it has to be employers). Still, get an Immigration lawyers' help. I'm in Tampa.

  • Can a person be deported if they are convicted of Operating an Unregistered Vehicle? I am here on a student VISA.

    I doubt that operating an unregistered vehicle is a felony or "crime of moral turpitude" so even though I agree that you should definitely get it checked out by a criminal lawyer, because every state is different and it depends on whether there is a "conviction" or "pretrial order" etc. but it probably is not something that would make you deportable. Usually it is things like drugs, theft, violent crimes etc.

    Yes, you can enter with your H1 as long as it has not expired. You only need to get a new stamp for the H4 when the H1 visa on your passport expires.

    You say that you had a domestic violence case and that you were "recognizance"- what I think that means is that you were " released on your own recognizance" which means there was not bail set for you- but that means that the case was going forward. That means that you had to come back to court- the case may not have been dismissed. That means you may have an arrest warrant on you for the domestic violence case. Be careful. Definitely let an Immigration lawyer help you.
