  • My independent/assisted living facility is not protecting me. I am very scared. Can you help me?

    If you were physically assaulted, you should immediately contact the police, file a report, and request that the matter be criminally investigated (and hopefully prosecuted) so that he does not continue his conduct in the future. ALFs are governed by Chapter 429 of Florida Statutes. The statute provides certain rights include the right to privacy and safety. You should certainly contact a lawyer well versed in this area of the law to discuss the case.

  • Why would a firm sit on a case for a year then decline to take it?

    The delay could be due to a number of reasons, but a year is unusual. The decision to turn down the case may have been predicated upon their review of the records, a consultation with an expert, or a failure of the facility to have insurance or collectible assets. Regardless, you should have another attorney review your case as soon as possible.

    You should not have been paid by a personal check. You should have received a check from the lawyer's trust account. You also should have signed, and been provided with, a closing statement which detailed where every penny from the settlement was going.

  • Can I sue for a prior hit and run?

    If you sustained injuries, if you purchased uninsured motorist coverage (UM), you should be able to recovery under your policy. If your lawyer cannot reach an amicable resolution of your claim with the carrier, you may file a UM lawsuit.
