  • What's the shortest time to recieve a divorce decree?

    I agree. 31 days is the minimum. It will also depend on the judge your case is assigned to. Some judges require an evidentiary hearing even if you have a settlement agreement filed. If your judge's office is in a different county from where your case is filed, getting his signature may take longer even if he does not require a hearing. The best scenario is where your lawyer carries the final decree to the judge's chambers on the 31st day.

    I agree with Ms. Smith's answer. In many counties, a lawyer can look at your file in the clerk's office online. He/she would be able to see if there was a hearing and if notice was sent to you. It is important you act promptly, as your time to appeal would be limited. Please consult a lawyer.

    In Georgia, citizens are not entitled to free legal counsel for divorce counsel, even when the parties are indigent. You might be able to find an attorney to handle your case for a reduced fee or pro bono. You can contact the State Bar of Georgia to inquire about finding a lawyer who takes pro bono work. Also, many counties in Georgia will have their own forms for filing a divorce without a lawyer. I would always recommend finding a lawyer if possible.

    I don't believe that missing a court date violates any conditions of your probation. You should contact the court where your speeding ticket is immediately. For a fee, they will probably lift the bench warrant and set a new court date. If you can't get through, get a lawyer to help you.

    Definitely call around, but I would think you could possibly find someone for as low as $500. The filing fees will be extra and should be a little over $200. You could be finished in as little as 31 days, but that depends on the judges in your area. Some judges require a court appearance to make out a case even in uncontested cases. If that is the case where you live, your lawyer will have to set the case down on your judges first open court date after the 31 days have expired. Good luck.

    Your question does not clarify whether you are the Plaintiff or the Defendant. If you are the Plaintiff and initiated the divorce action, then you should follow the advice previously provided in the prior responses. If you are the Defendant and were served with the action, then you will need to convince a judge that the marriage is not irretievably broken. An attorney should be retained to assist you with this.

    You should contact an attorney to discuss filing a contempt action. If you have saved the emails you sent your ex requesting him to sign the title over to you, you will certainly want to bring them to the attorney. Now, if you cannot find your ex to serve him with a contempt, and if your ex has the title to the vehicle, you might be able to get a replacement title to the vehicle. You would need your final decree and it would have to clearly identify the specific vehicle which was awarded to you in the divorce. You would want to talk to someone at your county tag office. There are other issues such as whether there is a lien on the vehicle, but they can discuss this with you.

    Unless there is an order to the contrary, you can have your check deposited where ever you want. You may want to do this and then offer to pay a couple of your wife's bills to help her out and not look like you abandoned her. That might be safer than leaving all of your money in a joint account that she has full access to. Sounds like she has a habit of saying one thing and then doing another.

    You are correct that the law presumes that any child concieved or born during a marriage is the child of the parties to the marriage, however, that does not mean that the judge has to order that your husband is the child's father. The judge may make findings of fact in the decree that your husband is not the father. If you allow the court to find that your husband is the father and he is ordered to pay child support, Child Support Recovery will certainly refuse to go after the real father. You need to contact an attorney in your area.
