  • CCan my probation officer tell me I can't drive a commercial vechile when that's my career b4 and after I was placed on probati?

    David’s Answer

The probation officer cannot tell you what type of job you can have. The probation officer can only enforce the sentence. If the judge did not prohibit you the PO cannot. You may not be able to leave the state and that could effect what type of job you can take with the CDL. Make sure you are in compliance with all other aspects of your sentence.

Do not accept this answer, obtain a copy of everything filed in the court case from the clerk and hire an attorney to review about whether he has the ability to file an appeal or habeas peitition.

  • Why would my finace have a warrent for something he done took care of back in March

    David’s Answer

You need to hire an attorney who practices in Gainesville GA to find out why he has the warrant. Did he forget to pay or appear for a traffic ticket, is he on probation, is it a new warrant for a crime he has never been arrested for? These are the details the lawyer can help answer for you.

  • Can a cop pull you over on the basis of leaving a known drug hotel?

    David’s Answer

Hire an attorney to file a motion to suppress challenging the basis of the stop of your car and the consent to search the car. You have good grounds to show the stop was not based upon any articulable suspicion and the consent was not voluntarily given. If you are successful the charges will be dismissed.

    David’s Answer

It does not mean anything. He might be busy, on vacation, or otherwise occupied. If you have concerns call the parole office.

  • What can I do to ensure my loved one comes home on time from jail?

    David’s Answer

I agree with the prior answer. He is in limbo because they will not release him on the street due to the hold. If you can get hold of the PO in the county with the hold a waiver could be done to allow the hold to go away, of course this depends on the nature of the probation violation and how much time he has left on probation.

  • Currently out on bond but have warrants in a different county?

    David’s Answer

If you are released on bond and have a hold for another agency because of a warrant you will be transferred to that other agency once you post the bond. If the warrants for the new case are for an offense that occurred after you were released on bond then the court where you first posted bond may remove to revoke your bond. It depends on the nature of the charges and the jurisdiction as to whether that is likely. You need to hire a lawyer who practices in both counties where you have charges pending to get the best result possible.

  • Is there any probono lawyers in clayton county ?

    David’s Answer

Your loved one should qualify for a public defender to represent him in court if he is unable to afford to hire his own attorney. It is very unlikely that a private attorney would agree to take a case of that magnitude without being paid.
