I work out of the Durham courts quite a bit. You will either contest the charge by way of a trial or if you don't want to fight the charges and if you have no record, you may qualify for a First Offender's program and get the case dismissed. If you have a record, other options may be available such as reduced charges or a PJC.
See questionDon't do or say anything. See if you get served with a warrant for a criminal case. If so, either hire an attorney or ask for the appointment of the Public Defender's office. Don't make ANY statements to the police or anyone else, except your lawyer.
See questionYou can call me. It is a criminal defense issue. I offer free consultations and handle many similar charges. Sincerely, Lynn Norton-Ramirez
See questionYou did violate the terms of your probation by leaving without permission. It is always better to call and confirm you are going to leave so you avoid this scenario. Be a thoughtful and responsible probationer and you avoid being found in violation. Work with the PO and if you are liked, you will always be the beneficiary.
See questionWere you ever convicted or did you complete a deferral program and earn a dismissal? A pardon will not happen but an expunction may. Have an attorney check out exactly what happened.
See questionYou indicated this was a civil case and the judge's ruling is a clear indication that you need help. If you can not afford to hire and attorney, go immediately to legal aid and other free legal service organizations. You need assistance as soon as possible. Some law schools also have clinical programs to assist members of the local community. You really need trained legal guidance,
See questionYour question is very confusing. Did you have a lawyer for the trial? If so, there is a short window in which to file an appeal. If you represented yourself, consult with a local attorney who specializes in these type of cases regarding the filing and preparation of an appeal. If you are within the time period for the filing of an appeal, you can do so yourself but this is NOT recommended.
See questionGo to the DMV as soon as possible if you do not know which court was handling the citation. If you know, then go to the Court Clerk's office, or hire a lawyer to do this. If you can hire a lawyer, do so. The case needs to be put on calender and the judge needs to be informed as to the reasons for the missed court date. Your driving privilege can be suspended and your record can reflect a Failure To Appear if this isn't handled immediately.
See questionYou need to make sure your case had a timely filing of an appeal. Contact another lawyer specializing in family law litigation and appeals and schedule a consultation. Time is of the essence.
See questionWhat does "screwed up" mean? This is very important. It is critical that you /he consults with the lawyer who set him up on the deferred judgement or hire a lawyer if he represented himself. A lawyer may make it possible to fix the "screw-up" and get him reinstated back on the program. There is no time to delay. This is important.
