    Wren’s Answer

    You'll want to appear or else the court may be able to enter a court order regarding your child without your input. I doubt you'll be able to have your expenses reimbursed. Depending on the circumstances, the petitioning party could be granted custody of the children that same day. You may want to consult a custody attorney at this point.

    If you are concerned about the safety of the child, you should contact your local child protective services unit with the local Department of Social Services. They will investigate for child abuse/neglect.

  • What steps should I take to appeal and file a complaint against a judge?

    You have the right to appeal any decision in the lower district court to the upper circuit court with ten calendar days, assuming this was heard in the lower district court (JDR). You are able to file this notice of appeal with the district court's clerk. You should ask your counsel about this option first because it will cost more money, more time, and an appeal fee. You also open yourself up to an unfavorable ruling as this will be a completely new trial, not just an appeal of the lower court's decision.

  • I failed to appear in my court date because of speeding ticket and I did find the ticket online and paid full amount, ?

    Wren’s Answer

    Contact the court clerk where the case was heard and make sure that you did not receive a failure to appear (you don't usually need to appear for a speeding ticket, unless there were additional charges, such as reckless driving). You should also ask if there was anything else you needed to do to make sure this case is completed. You don't want to receive a notice that your license has been suspended for failure to pay traffic fines or some outstanding loose end. If you were unhappy with the ruling, or wished to be able to fight the ticket or ask the court for leniency, you would need to appeal the ticket within the time limit in your case. A local speeding ticket lawyer who practices in your jurisdiction would be better suited to tell you as to whether an appeal of the ticket is available or even a reasonable option as to your guilt / innocence.

    If the man who you consider to be your father ever legally established or establishes that you are his child, then you would be an heir to his estate. This assumes that he does not have a Will disinheriting you either expressly or by leaving everything to his other family and that your father dies in Virginia (as there are certain intestacy statutes that apply when there is not a Will, and those are different in other states). His name would need to be on your birth certificate or there would need to be a paternity test to establish he is your father. Usually, if there is a Child Support Order in place, then paternity was legally established.

    In Virginia, a dog isn't immediately assumed to be aggressive or liable for such an injury. There must be prior knowledge of the dog's aggression or potential to do such a thing as Virginia is still in the minority with the dog's "first bite" being "free." In addition, the dog's breed isn't enough to deem it aggressive, or enough to assume the owner had prior knowledge of its aggressive behavior. Finally, Virginia is a contributory negligence state meaning if the injured party is at all at fault, there is no recovery. That being said, if your insurance will not defend you, this will likely be a very expensive out-of-pocket endeavor.
