    Sometimes transfers like this happen, and it takes time for the file to arrive to the new location. You should receive the new notice within next 3-6 months (average). You could submit an email inquiry to the Fairfax asylum office. Good luck!

    This is a great question. A similar situation just happened to one of my Clients. The key here would be to prepare a very thorough response to the RFE sent by the USCIS. You would want to include all the evidence to prove that the divorce was in fact final, and in accordance with the laws of his home country. You have a lot at stake here: if the USCIS is not convinced that your husband's divorce in his home country was final, your husband might be found ineligible for the immigration benefits. The USCIS might also initiate the deportation proceedings. I would definitely recommend hiring an immigration attorney for the response to the RFE.

    You can still get divorced without a separation agreement, but only after being separated for 12 months (unless there are other grounds, such as adultery, cruelty, abandonment, etc. applicable to your situation). If you want a judge to order your husband to return the engagement rings, you need to request a hearing on this issue. It is likely they will be awarded to you.     In VA, for a no-fault divorce, there is a mandatory waiting period of 12 months (6 months if you do not have children and you both signed a separation agreement). The waiting period starts from the date of separation: when at least one party formed an intent to permanently leave the marriage and the parties stopped cohabiting. There are also grounds for divorce, i.e. adultery, when you do not have to wait 12 months to file. As far as spousal support, it is determined on case-by-case basis, and there is generally no "entitlement" for support.
    I recommend starting the process by talking with a local attorney, and then discussing it with your spouse to find an amicable resolution of your situation.

    I completely agree with Ms. Blackwell. The fastest and the easiest option for your sister to immigrate would be through your mom. Even though it will take at east 5 years, it is still the best option. In the meantime, your sister can visit you and your mom on a tourist visa. Also, depending on your family's situation, your sister can explore an option of coming to the U.S. on a student or work visa. Good luck!

    The short answers to your questions are:
    1) no, your move to VA will not hurt your case, as long as you timely notify the USCIS
    2) the officer can discover your move through a number of ways, such as any documents you submit, your admissions at the interview, etc.
    3) no, the move will not revert your time back to "zero," the timeline will be counted since the date the USCIS accepted your application (the date on your receipt).

    If you decided to back out of this deal, make sure to let the owner know about this in writing and as soon as possible. If the owner refuses to refund the earnest money deposit, you can sue him in general district court. The owner will most likely countersue for lost time on the market.
