  • How should surviving siblings deal with beyond-the-grave pressure from their deceased brother regarding their mother's estate?

    Dale’s Answer

    The trustee or personal representative will be required to follow the terms of the trust with regard to the distribution of the trust assets to the three surviving siblings. At that point, it will be up to the siblings individually to decide if they wish to honor their deceased brother's request. While one of the siblings may be be in a financial position to make such a gift, that would not obligate the disabled sibling to make a similar donation.
